These terms apply to any forum advertisement or forums for which you pay us a fee to place on this site.
If you place an advertisement on CPDpoint, please read "Terms regarding advertisements and forums". If we are hosting a forum for you, please read both "Terms regarding advertisements and forums" AND "Terms regarding forums hosted by CPDpoint" below.
1. Terms regarding advertisements and Forums
By advertising on this site, you understand that you are responsible for the representations you make in the content you submit. You also understand that CPDpoint always retains the right to refuse, remove or request corrections to any material that you place on this site.
By advertising on this site you have declared to
CPDpoint
that your advertising material does not have the capacity to violate:
i.
Australian Trade Practices Act (administered by the Australian Competition and Consumer Commission
ii.
Australian
anti-discrimination laws (administered by the
Human Rights and Equal Opportunity Commission)
iii.
Intellectual property of others (e.g. copyright, trade mark or obligation of confidentiality. Refer to IP Australia for information
about different types of intellectual property)
iv.
Australian Privacy Act (administered by the Office of the Privacy Commissioner)
v.
Any other law, regulation or code of conduct that applies to the material you have submitted or industry you represent
If your advertising material contains an error, or you become aware that your advertisement has the capacity to violate any law, you are responsible for making the correction. You have the ability to access and correct your advertisement at any time from your account area.
The following terms will also apply to all advertisements paid for at CPDpoint.
1.
Payment for transactions at CPDPoint is processed in Australian
dollars.
2.
Secure Sockets Layer (SSL) encryption is employed to ensure the security of all personal information submitted on this site. SSL is the industry standard used by all reputable e-commerce sites and it is compatible with most browsers.
3.
Credit card payments are processed instantly at this site. Please ensure you have sufficient funds available in your account.
4.
Unless stated otherwise, the standard advertising (or hosting) period for all advertisements (or forums) is one calendar month. You can advertise on a monthly basis or pre-pay for up to 24 months.
5.
You can renew, store or deactivate your advertisement (or forum) at any time from your account area. The balance of unused months is not refundable.
6.
CPDpoint will not be liable for any delay or failure to publish advertising (or provide forums) caused by factors outside our reasonable control. Examples of these factors include delayed payment by you, an act of God, war, breakdown of plant, industrial dispute, electricity failure, or legal restraint.
7.
A non-refundable payment-processing-fee applies to each basket of items ordered.
8.
A non-refundable document-attachment-fee applies per month if you attach a document to your advertisement (or forum).
9.
A non-refundable offline-payment-fee applies if you do not use a credit card to pay for your advertisement at the time of submitting your listing (or forum).
10.
If you live in
Australia
, the final price paid for advertising includes Goods and Services Tax (GST).
11.
A receipt will be e-mailed to you immediately after payment is processed. A record of your transaction is available in your account area, which you may access at any time you log in to this site.
2. Terms regarding Forums hosted by CPDpoint
CPDpoint forums are provided for the purpose of education and customer support. Our terms of use apply to every forum hosted on this site. A message posted on CPDpoint forums is the view of the individual who posted the message, not the view of CPDpoint. We are not responsible for the accuracy, completeness or usefulness of any message posted at a forum hosted by us.
If you use forums hosted by CPDpoint, you have agreed that you will not post any material that is false, inaccurate, defamatory, abusive, vulgar, hateful, harassing, obscene, profane, pornographic, racist, threatening, or that is invasive of a person's privacy, or in violation of any law. You also agree not to use this site to breach any intellectual property laws.
Each forum hosted by CPDpoint is a private group overseen by a moderator. It is the responsibility of each group to define unacceptable conduct during its formation and it is the moderator’s role to enforce any sanctions against group members who engage in unacceptable conduct.
A forum member who objects to a posting of another member is encouraged to contact the forum moderator for advice, not CPDpoint. The moderator can do any of the following at their discretion: approve people to join; ban members from participating in the forum; or promote members to become moderators of discussions.
If at any time CPDpoint becomes aware of conduct occurring on forums that is in breach of our terms of use,
we may pursue any or all of the following courses of action: request that you rectify the situation; terminate your access to the forum; terminate your contract without refund; refuse to enter into any subsequent contract with you; report your unlawful violation to the relevant authorities.
